Part A – Terms and Contract

1. Terms

These Terms explain how you interact with us, Longevity HQ Pty Ltd (ACN 683 448 375) (we, us, our) and everything we offer. This includes our website, products, services and memberships (our Services). We will follow these Terms. We also expect that you will follow these Terms.

2. Contract

2.1 How a contract is formed

By browsing our website, booking or buying our Services, signing up for a membership, or otherwise clicking “I accept”, you’re saying “yes” to these Terms and entering a contract with us.

2.2 What the contract is made up of

The contract between us is made up of these Terms.

  • Parts A, B and D apply to everyone.
  • Part C only applies if you sign up for a membership with us.

2.3 Additional forms or requirements

    • Some of our Services may have extra requirements.
    • Service-specific forms: to book or use certain Services, we may ask you to sign or agree to additional terms, for example, a consent form, health questionnaire, or liability waiver. We’ll give you these at the time of booking or before your session.
    • Participation requirements: some Services may also have specific participation rules, for example, instructions on how to safely use a sauna or other equipment. You agree to always follow these instructions.

 

Any additional forms or participation rules form part of your contract with us.

Part B – Our Services

3. Accounts

To book, use and enjoy our Services, you may need to create an account. Please make sure the details you provide are true and kept up to date. Keep your login details safe and secure. You’re responsible for any activity that happens under your account. If you think your account has been compromised, let us know right away.

4. Age policy

4.1 Minimum age

Our Services are designed for guests aged 16 and over. Guests under 18 must have a parent or legal guardian’s consent and must be accompanied by them during sessions. We may require the parent or legal guardian to sign a liability and/or consent form on the minor’s behalf.

4.2 Confirmation of your age

By booking or signing up for a membership, you confirm that you meet the age requirements. We may ask for proof of age if needed.

5. Prices and payments

5.1 Prices

Prices are as shown on our website or at the time you make a booking. We reserve the right to update our pricing from time to time. Existing session packs or bookings won’t be affected by updated pricing. 

5.2 Payments

For bookings that aren’t covered by a membership or session pack, payment is required at the time of booking. The payment methods we accept will be shown at checkout, and we may update these from time to time.

6. Bookings, cancellations and refunds

6.1 Bookings may be limited

Our sessions and Services can book out, so we recommend booking early. If there’s a waitlist, we’ll let you know and keep you updated about your spot. All bookings are subject to availability at the time you make them.

6.2 Cancellation by you

We know plans change and that you might need to cancel a session.

  • If you cancel or reschedule at least 24 hours before your session, you’ll receive a full refund, or the session will go back into your membership or session pack for you to rebook later.
  • If you cancel with less than 24 hours’ notice or don’t show up, your payment or session will be forfeited.

6.3 Late arrivals

If you are more than 15 minutes late to a session, we reserve the right to cancel your booking or deduct the corresponding amount of time from your booking without any refund to you. 

6.4 Cancellation or rescheduling by us

If we ever need to cancel or reschedule a session, we’ll offer you a refund, credit, or new time that works for you.

6.5 Refunds

We don’t offer refunds for change of mind. Refunds will only be provided where we are required to do so by any applicable laws.

7. Session packs

7.1

  • If we offer, and you purchase, a pack of sessions, these may be subject to additional terms and conditions advised at the time of purchase. However, generally, our session packs:
  • don’t guarantee you a booking – you still need to make a booking for each session, which is subject to availability;
  • may be limited to the type of service or location you purchased the pack for;
  • are non-transferable unless we say otherwise;
  • must be used before their expiry date (shown at purchase);
  • are not refundable except as required by law; and
  • are subject to our usual cancellation, rescheduling, and late-arrival rules.

8. Gift cards

If we offer, and you purchase gift cards, they may be subject to additional terms and conditions advised at the time of purchase. However, generally, our gift cards:

  • are valid for the location and/or Services type shown on the card, or for any service if they are value-based;
  • don’t guarantee a booking – the person using the gift card still needs to make a booking, which is subject to availability and remains subject to our usual cancellation, rescheduling, and late-arrival rules;
  • are valid for 5 years from the date of purchase (or longer if required by law);
  • can’t be exchanged for cash; and
  • can be partially redeemed, with any remaining amount available for future use until expiry (you can top up the difference with another payment method if needed).

9. Health and safety

9.1 Health and safety obligations

Your wellbeing and safety are important to us. To help us keep everyone safe, you agree to:

  • tell us about any relevant health conditions, injuries, or other factors that may affect your ability to safely participate in our Services;
  • follow any reasonable directions or instructions from our team; and
  • meet any participation requirements we let you know about (for example, minimum age, clothing, or hygiene requirements).

9.2 You should seek advice

If you’re unsure whether any of our Services are right for you, we recommend you speak with a health professional before booking.

10. Standards

10.1 Our standards

We want our spaces to be safe, respectful spaces for everyone. By using our Services, you agree to adhere to the following standards.

  • Respect others’ privacy – no filming, photography, or recording of other guests or our staff without permission.
  • Wear suitable clothing – follow our dress requirements and maintain good hygiene.
  • Respect personal space – be mindful of others’ comfort and physical boundaries, including those of our staff.
  • Be considerate – keep noise to a reasonable level and follow our team’s directions.
  • Zero tolerance for misconduct – we do not tolerate harassment, abuse, discrimination, or any unsafe, threatening, illegal, or inappropriate behaviour.

10.2 If you breach these standards

If you breach these standards, we may ask you to leave immediately and may refuse future service. In serious cases, we may involve law enforcement.

11. Liability waiver and risk acknowledgement

11.1 General wellness only

Our Services are designed to support general health and wellbeing. They are not a substitute for medical advice, diagnosis, or treatment. It is your responsibility to always consult your healthcare professional before using our Services. This is especially the case if you are pregnant, have a medical condition, or are taking prescription medication.

11.2 No medical advice

Our Services and anything we provide you (whether in person, online, or in writing), are not, and should not be taken as, medical advice. We do not diagnose, prescribe, or guarantee any particular outcomes, including health outcomes.

11.3 Fitness to participate

You represent that you are in suitable physical condition to safely enter our locations and use our Services. You confirm you have no pre-existing medical conditions, injuries, or other factors that would make use of our Services unsafe, or you have sought medical advice and been cleared to use our Services.

11.4 Assumption of risk

You acknowledge that using our facilities and participating in wellness activities carries some risk, including:

  • slipping on wet surfaces;
  • exposure to extreme heat or cold (for example, saunas, steam rooms, ice baths);
  • equipment malfunction;
  • actions of other guests; and
  • potential aggravation of pre-existing injuries or conditions.

 

You voluntarily accept and assume all risks of injury, illness, or death that may arise from entering any of our locations and/or booking or using any of our Services. If you experience discomfort or adverse effects during a session, you agree to stop immediately and notify our team.

11.5 Your Responsibility

You are responsible for your own safety and wellbeing (and that of any guests you bring with you or any minor that you give consent for). If you are booking on behalf of a group, you must ensure everyone is aware of these Terms. You agree to always follow our instructions and requirements.

11.6 Our liability

To the maximum extent that the law allows, we are not liable for any injury, loss, damage, or death arising from you entering any of our locations and/or booking or using any of our Services.

11.7 Release

You, and anyone entitled to act on your behalf, agree to release and hold harmless us, our officers, employees, and contractors from any claims or demands arising from you entering any of our locations and/or booking or using any of our Services.

11.8 Indemnity

You agree to indemnify and hold us harmless from and against any claims, losses, damages, costs, liabilities, and expenses (including legal fees on a full indemnity basis) that we incur because of:

  • your breach of these Terms;
  • your misuse of our Services; or
  • any claim brought against us by a third party that relates to your actions or omissions while at our locations or using our Services.

12. Our right to refuse

12.1 Right to refuse

We want everyone to have a safe and positive experience. We may refuse a booking, stop a session, or ask you to leave. We can do this in our reasonable discretion. This includes if:

  • we can’t verify your age;
  • you don’t agree to any additional documents or waivers required for a Service;
  • we believe it’s unsafe for you to participate or for someone else;
  • you don’t follow our instructions or meet our standards; or
  • you behave in a way that is unsafe, disruptive, or inappropriate.

12.2 If we refuse

If we need to refuse service for these reasons, you may not be entitled to a refund.

Part C – Membership Terms

13. Length of your membership and cancellation

13.1 Auto renewing monthly membership and minimum commitment

Your membership runs month to month, with a minimum commitment of 3 months to start. It will automatically renew each month until it is cancelled in line with these Terms.

Some memberships may require you to pay upfront, for example, 6 or 12 months in advance. In these instances, your minimum commitment is extended for the prepaid period that you’ve purchased. After that period, your membership will automatically renew on a monthly basis until it is cancelled in line with these terms.

13.2 Membership cancellation by you

After your applicable minimum commitment, you can cancel at any time by giving us 14 days’ notice.

  • If you give notice more than 14 days before the end of the month, your membership will end at the end of that same month. For example, if you cancel on 10 March (more than 14 days before 31 March), your membership ends on 31 March.
  • If you give notice within 14 days of the end of the month, your membership will end at the end of the following month. For example, if you cancel on 25 March (within 14 days of 31 March), your membership ends on 30 April.

 

You’ll keep your membership benefits until the cancellation date.

13.3 Membership cancellation by us

We may cancel your membership at any time. If we do, we’ll give you a prorated refund of your membership fees (considering how long is left on your membership including any minimum commitment).

13.4 Exclusive to you

Your membership is only for you and cannot be reassigned to someone else. 

14. Membership fees and payment

14.1 Membership fees

The membership fees vary for each membership tier. They are displayed on our website and are displayed as including GST.

14.2 Payment of membership fees

The membership fees are payable in advance. Most membership fees are charged monthly. However, some memberships may require a longer upfront payment (for example, 6 or 12 months). This will be clear at the time of purchase. If we offer a discount, including for advance payment, it’s entirely at our discretion and we don’t guarantee the same discount will apply for any future renewals.

14.3 Payment method

When you sign up, you’ll give us your payment details, and we’ll automatically charge the payment method you provided for your minimum commitment period when you sign up and then each month. You must:

  • keep your payment details up to date and let us know if they change;
  • make sure you have enough funds accessible in the payment method for the fees;
  • take responsibility for any charges you incur due to incorrect details or insufficient funds.

 

If a payment fails, you agree we can retry until payment works or ask for payment another way or recover the amount (including debt collection costs).

14.4 Increase of membership fees

We may change membership fees from time to time.

  • If we do, we’ll give you at least 30 days’ notice before the new price takes effect.
  • If you don’t agree to the new price, you can cancel your membership in accordance with clause 13.2. If you don’t cancel, the new price will apply from your next billing cycle or renewal date.
  • If we agreed with you when you purchased a membership that your fee was locked in for a fixed period, we won’t increase your membership fee during that period, but may do so once it ends.

15. Pausing your membership

15.1 Pause periods

We know life happens, so you can pause your membership if you need to take a break.

  • The minimum pause period is 2 consecutive weeks.
  • The maximum pause period is 4 weeks in total (whether taken all at once or in separate periods).

15.2 How to pause your membership

To request a pause, you can contact us and ask. You can pause your membership at any time. We’ll calculate the unused portion of your current billing period and apply it as a credit to your next payment when your membership resumes.

15.3 What happens while it is paused?

While your membership is paused:

  • we won’t charge you your membership fees; and
  • you won’t be able to use your benefits until your membership restarts.

 

Your membership, including payment and access to benefits, will automatically restart once the pause ends.

16. Tiers and benefits

16.1 Tiers

The tiers we offer are described on our website. Some tiers may have limited availability, either in how many people can join or when sign-ups are open.

16.2 Changes to tiers

We may change, add, or retire tiers from time to time. If a change affects your existing membership, we’ll let you know in advance and give you options (for example, to move to another tier or cancel your membership).

16.3 Upgrading or downgrading memberships

You can upgrade your tier at any time by paying the difference between your current tier and the new one. Some benefits of the upgraded tier may not be available depending on when you upgrade. You can only downgrade at the start of a new month or billing cycle.

16.4 Benefits

Each tier has different benefits. These are displayed on our website. You will get access to the benefits included in the tier that you sign up for.

  • Benefits may include session credits, discounts, or other perks.
  • Benefits don’t roll over month to month. This means if you don’t use them during the month, they will expire. Unused benefits aren’t refundable or redeemable for cash.
  • Any changes to membership benefits will be communicated to you in advance.

16.5 Availability of benefits

Some benefits, like access to certain therapies, sessions, or equipment, may have limited spots or be available only at set times. All benefits are subject to booking and availability at the time you want to use them. We can’t guarantee that every member will be able to book every benefit, so it’s up to you to reserve your spot early and use your benefits within the relevant timeframe.

16.6 Benefit terms

Benefits are subject to these Terms, however, some may come with extra terms that also apply, for example a limited timeframe in which you can use the benefit. These may be explained at the time a benefit is made available to you or in the description of your tier.

16.7 Changes to benefits

We aim to provide all benefits as described, but sometimes a benefit may become unavailable for reasons outside our control. If that happens, we’ll try to replace it with something of equal or similar value. Unless you have a legal right to cancel, this doesn’t give you a right to end your membership or receive a refund.

We’ll only make changes when reasonably necessary and will aim to give you as much notice as possible. This clause doesn’t limit clause 16.5 above.

Part D – General Terms

17. Use of our website

17.1 Your obligations

You’re welcome to use our website to learn about our Services, sign up for memberships, and make bookings, but only for lawful purposes. You agree that you will not:

  • use our website in a way that breaks any law or infringes anyone’s rights;
  • attempt to gain unauthorised access to our systems or interfere with the security of our website;
  • copy, scrape, harvest, or use automated tools to collect data from our website;
  • use any of our content (including text, images, videos, or pricing) for your own commercial purposes without permission; or
  • use our content or data for training AI models or other machine learning tools unless we give you prior written consent.

 

We may suspend or block access to our website if you misuse it.

17.2 Links to other websites

Our website may include links to third-party websites, products, or services. These are provided for your convenience, but we don’t control them and aren’t responsible for their content, accuracy, or privacy practices. We make no representations or warranties about third-party websites, products, or services, and we exclude all liability for any loss or damage that may arise from your use of them.

18. Privacy

We collect and handle personal information in line with our privacy policy (available on our website). By using our Services, you agree to our collection and use of your personal information as set out in that policy.

19. Our intellectual property rights

Everything on our website, including text, images, logos, and designs, and/or anything similar in relation to our Services, belongs to us or our licensors. You must not use, copy, modify, or distribute our content unless we give you written permission. If you give us feedback, suggestions, or ideas about our Services, you agree that we own them and may use it freely (including to improve our Services) without payment to you.

20. Liability

20.1 No limitation where the law doesn’t allow

Nothing in this contract limits any rights or remedies available to you under any applicable law, including the Australian Consumer Law. However, if any such applicable law allows us to limit or exclude our liability, then our liability is limited or excluded as much as that such law allows.

20.2 General limitation of liability

Without limiting the above, to the extent and as far as the law allows:

  • we are not liable to you, whether such liability is based in breach of contract, tort (including negligence), statute, or otherwise, for any loss or damage that is indirect, incidental, special, punitive, or consequential, including losses that do not arise naturally from a breach of these Terms; and
  • our total liability in connection with this contract, whether under contract, tort (including negligence), statute, or any other legal basis, will not exceed $150.

20.3 General exclusion of warranties

Without limiting the rest of this clause and so far as the law allows, all express or implied guarantees, warranties, representations, or other terms and conditions relating this contract or its subject matter that are not contained in this contract are excluded from the contract, including any warranties or representations relating to quality, fitness for use or for any particular purpose, guarantee of any particular outcomes, reliability, functionality, and/or performance.

21. Changes to these Terms

21.1 How can these terms change

These Terms can be changed if we agree in writing, or if we tell you about a change in accordance with the rest of this clause. 

21.2 Changes with immediate effect

If a change won’t disadvantage you, or will benefit you, we will tell you about the change and the change will take effect immediately.

21.3 Changes with your consent

If a change may disadvantage you, we’ll give you at least 30 days’ notice. If you don’t agree, you can tell us and end your membership or any current bookings, and we’ll give you a pro-rata refund of fees paid. If you don’t contact us within the notice period, we’ll assume you accept the change, which will take effect at the end of the notice period.

21.4 Last updated

The date these Terms were last updated are set out at the start of the Terms.

22. General

22.1 Notices from us to you

We’ll send notices to the contact details you’ve given us, usually by email. Please keep your details up to date. Emails are taken as received when sent, even if you don’t open or reply.

22.2 Notices from you to us

You can send us notice by email or post to the contact details on our website. Your notice is taken as received when we confirm it, or 24 hours after you send it (unless you get a bounce-back or error)

22.3 Complete agreement

This contract is the whole agreement between us. It replaces any prior agreements, understandings, representations, whether they were verbal or in writing.

22.4 No waiver

Not using or enforcing any powers or rights under this contract doesn’t mean that a party can’t use or enforce it later. Any waiver of rights must be in writing and doesn’t waive future breaches.

22.5 Removing invalid terms

If a court finds any part of this contract to be illegal or not valid, that part will be removed, but the rest will still apply.

22.6 Assignment by you

You can’t assign or transfer this contract or your rights on it to anyone else without our written consent. We can assign or transfer this contract and our rights under it on written notice to you, but only if we ensure that the incoming party undertakes to be bound by our obligations under it.

22.7 Governing law and jurisdiction

The laws of NSW, Australia govern this contract. Its courts (and appeal courts) have non-exclusive jurisdiction over disputes.

23. Interpretation

In these Terms, words include their singular and plural forms, headings are for convenience only, defined words include their other grammatical forms, references to laws include any amendments or replacements, “$” means Australian dollars, references to a party include its successors and permitted assigns, and “including” means including but not limited to.
